The State Election Commission for U.T., Chandigarh is headed
by a State Election Commissioner appointed under Article 243 ZA read with
Article 243 K of the Constitution of India and also relevant laws of Punjab
Municipal Law and the Punjab Panchayati Raj Acts as extended to the U.T. of
Chandigarh by separate Acts.
The Commission was initially constituted for N.C.T. of Delhi and
subsequently it was assigned the work of elections to the M.C. Chandigarh
and the Gram Panchayats (3 tier system) in Chandigarh. No supportive post
to assist the commission in election work has been provided so far. Only
the Secretary of the Municipal Corporation of Chandigarh is designated as
‘ex-officio Assistant Election Commissioner’ for U.T., Chandigarh. Some
staff from U.T., Chandigarh Administration is provided in diverted capacity
as and when an election is to be conducted. However, the officers and staff
in Delhi office also look after the regular election work for Chandigarh
also.
The nature of election work is regular in sense that though the term of the
each House is 5 years yet due to different dates of various election in U.T.,
Chandigarh, the commission is always busy in holding elections and
bye-elections as a result of death/resignation of a member or on expiry of
the term of a House. The post election work includes election petitions,
litigation in courts, maintenance and upkeep of valuable election records,
settlement of account of election expenses, disposal of election records
after expiry of the prescribed period, keeping the electoral rolls uptodate
for use at an election within a given time etc. etc. To cope with the above
items of work, office at Chandigarh needs regular staff for which efforts
are on as the quality of work done by the borrowed staff is not up to the
mark and staff at Delhi has to bear the brunt of gigantic task of
Chandigarh elections.
For the purpose of preparation of electoral rolls and for conduct of
elections to the various bodies, the State Election Commissioner appoints
the following officers belonging to the Govt. of U.T. of Chandigarh:-
(a) Electoral Registration Officers
(b) Assembly Electoral Registration Officers
(c) Returning Officers
(d) Assistant Returning Officers
(e) Election Observers
(f) Election Expenditure Observers
(g) Presiding and Polling Officers
(h) Counting staff
(i) Staff at Collection Centres to receive polled ballot boxes and election
documents after the close of poll.
(j) Sector officers for a group of polling stations tosupervise the poll.
(k) A large No. of Police Officers/ Police personnel are also deputed.
At the time of any election in U.T. Chandigarh, the State Election
Commissioner
with senior officers and supportive staff shifts temporarily to Chandigarh
and remains there till completion of elections.
Necessary funds for elections are provided to the Commission by the U.T.
Administration of Chandigarh.
